African Court on Human and Peoples’ Rights (2022). African Commission on Human and Peoples’ Rights v. Republic of Kenya. Application No. 006/2012. Judgment on reparations, 23 June 2022. Arusha. Linked copy: summary hosted by the University of Arizona.
The reparations judgment that followed the 2017 merits ruling. The Court ordered Kenya to pay KES 57,850,000 for material damage and KES 100,000,000 for moral damage into a community development fund for the Ogiek; to identify and delimit the Ogiek’s ancestral lands with them and issue a collective title; and to consult the Ogiek effectively on “development, conservation or investment projects on Ogiek ancestral land.” The wiki cites it as the clearest recorded remedy for coercive exclusion from a water source, and as the case behind the mechanism of a remedy granted on paper and not yet carried out.
